In November 2020, the state of Oregon became the first in the United States to license and regulate the manufacturing, transportation, delivery, sale, and purchase of psilocybin products and the provision of psilocybin services. On December 27, 2022, Ballot Measure 109 was officially codified in Oregon law in ORS 475A.

The OHA will begin accepting applications for licensure on January 2, 2023. Notably, the OHA does not have the authority to limit the number of licenses issued for any of the four license types.

The Oregon Health Authority (OHA) is responsible for regulating the legal psilocybin industry, including the possession, production, sale, and administration of psilocybin. The OHA has established a licensing process that offers a range of licenses for individuals and businesses interested in offering psilocybin services.

There are four license types: 

  • Manufacturer License – allows the license holder to legally cultivate, extract, and or edible psilocybin products to be sold to licensed service centers for administration sessions. It does not allow an individual to grow psilocybin-producing mushrooms for personal use.
  • Service Center License – allows the license holder to operate a center where psilocybin services are provided, including psilocybin preparation, administration, and integration sessions with a licensed facilitator. With this license, psilocybin can be provided to individuals by those who have received a facilitator license (described below).
  • Facilitator License – is the license for an individual to facilitate and oversee a Service Center’s psilocybin activities including preparation, administration, and integration sessions. The rules require the facilitator to have specific qualifications, including completing the OHA-approved psilocybin facilitator training program and passing the associated exam, as described in ORS 475A. 330.
  • Laboratory Testing License – allows the license holder to test psilocybin products e.g., quality, purity, potency, speciation, pesticides, and residual solvents. In addition, psilocybin testing accreditation is obtained through the Oregon Environmental Laboratory Accreditation Program (ORELAP).

Psilocybin licenses are applied through the OHA. The application process includes completing an online application form, detailed supporting documents, and paying a fee. The OHA will review the application and may request additional information or documentation before deciding whether to issue a license. To qualify for a psilocybin license, businesses must meet certain requirements and standards, including having a secure and appropriate facility for the production and sale of psilocybin products and having robust quality control measures in place.
